Serbian attorney tariff 2026 - calculator and fee table

Serbian attorney tariff (advokatska tarifa) 2026: fee calculator by tariff item and amount in dispute, table in points and RSD, point value 50 RSD.

Result

Choose a tariff item and enter the value in dispute, then press "Calculate".

The calculator computes fees under the Tariff of Attorney Fees and Expense Reimbursement (Official Gazette of the RS Nos. 43/2023 and 56/2025), adopted by the Management Board of the Bar Association of Serbia. Choose a tariff item, enter the amount in dispute, and the tool prints the point count, the point value and the amount in dinars. The Tariff says "poen" (point); in practice "bod" is used just as often.

How the fee is calculated: points × point value

Every attorney action carries a number of points. The dinar amount is the point count multiplied by the point value, which is RSD 50.00 (Article 15 of the Tariff).

In valued disputes the point count depends on the amount in dispute (Tariff item 13). Note that the Tariff states the amount-in-dispute bands in points too: the first band is "up to 1,000 points", which is RSD 50,000 at the current point value. In disputes that cannot be valued (divorce, unfair dismissal, trespass to possession) the point count is fixed by type of dispute (item 14). In criminal proceedings the basis is the threatened sentence (item 1).

Other actions derive from the fee for the submission that starts the proceedings:

  • statement of defence and reasoned submissions - same as the claim; other submissions - 50% (item 13);
  • hearing held - same as the claim, plus 100 points per started hour; adjourned hearing the attorney attended - 50%, plus the started hour (item 15);
  • appeal, revision and other legal remedies, and replies to them - the claim fee increased by 100% (item 16);
  • enforcement motion, hearing and remedy in enforcement proceedings - same rules, based on items 13 and 14 (items 18-20).

Example: a dispute worth RSD 1,000,000. Claim 375 points (RSD 18,750), one-hour hearing 475 points (RSD 23,750), appeal 750 points (RSD 37,500).

Attorney tariff table

Civil litigation, valued disputes, point value RSD 50. The hearing includes the first started hour. The same amounts apply to the enforcement motion, hearing and remedy in enforcement proceedings.

Above RSD 33,350,000 the 1,500-point fee grows by 1 point per started 10,000 points of value (RSD 500,000); above RSD 135,000,000 by 1 point per started 30,000 points (RSD 1,500,000); above RSD 335,000,000 by 1 point per started 150,000 points (RSD 7,500,000), that last addition capped at 1,000 points. The calculator handles this itself.

The Bar Association of Serbia's tabular overview of the Tariff starts the band above RSD 135,000,000 at RSD 85,165.00 and the band above RSD 335,000,000 at RSD 91,831.67 (capped at RSD 141,831.67). Up to those thresholds the table prorates the addition, without rounding the last started step up to a whole point, and the calculator computes it the same way.

Criminal proceedings - defence at a trial session or procedural action held, and the submissions listed in item 4 (item 1):

Threatened sentence Points RSD
fine or imprisonment up to 3 years 600 30,000
over 3 up to 5 years 750 37,500
over 5 up to 10 years 1,000 50,000
over 10 up to 15 years 1,500 75,000
over 15 years 2,000 100,000
imprisonment of 30-40 years or life imprisonment 2,500 125,000

Defence also carries 100 points per started hour. A trial session not held that the attorney attended is 50%, and an appeal against the judgment is the fee increased by 100% (items 3 and 5).

Point value and its history

  • From 5 July 2025: RSD 50.00 - Decision of the Management Board of the Bar Association of Serbia No. 674/2025 of 21 June 2025, Official Gazette No. 56/2025.
  • From 3 June 2023: RSD 45.00 - the new Tariff, Official Gazette No. 43/2023 of 26 May 2023. It repealed the Tariff from Official Gazette Nos. 121/12, 99/20 and 37/21.
  • From 1 January 2013 to 2 June 2023: RSD 30.00 - the Tariff from Official Gazette No. 121/2012 (Article 15). The Bar Association's 2021 decision amending tariff item 13 (Official Gazette No. 37/2021) confirms the same point value.

Because the amount-in-dispute bands are in points as well, the 2025 amendment moved the thresholds too: the first band rose from RSD 45,000 to RSD 50,000.

Increases and reductions of the fee

  • Multiple clients or defendants: +50% for the second and each further party, per action (items 7, 12, 17, 21).
  • Multiple cumulative claims in a submission, or several separately tariffed actions in one submission: +50% for each further one (items 13 and 14).
  • Work at the request of the client or an authority at night (22:00-7:00), at weekends and on public holidays: +50% (Article 4).
  • Legal assistance in a foreign language: +50% with the client's consent; a court awarding costs is not obliged to apply that increase (Article 3).
  • By written agreement the fee may be reduced to no less than 50% of the tariff amount (Article 4).
  • Expenses: absence from the office 100 points per started hour, at most ten hours a day; travel by own car 30% of the price of the most expensive petrol per kilometre; postal, telephone and similar costs per receipts or a flat 2% of the fee (Article 9). A VAT-registered attorney adds VAT (Article 13).

What the tool does not cover

The tool does not carry misdemeanour and commercial-offence proceedings, non-contentious, administrative and insolvency proceedings, proceedings before the Constitutional Court, or general acts of companies. For contracts it computes only the item-13 variant with the 550-point minimum, not the percentage of up to 2.5% of the value. It does not add actions up into a bill of costs and does not compute court fees. Compare the figures with the text of the Tariff before they go into a bill of costs or a quote to a client.

Assumptions

  • The tool covers the most-used tariff items (civil litigation, enforcement, criminal defence by threatened sentence, contracts, advice), not the whole Tariff.
  • For hearings only the first started hour (100 points) is included; each further started hour adds another 100 points.
  • The tool does not compute increases or reductions: multiple clients or defendants, multiple cumulative claims, night, weekend and public-holiday work, foreign language, an agreed fee, VAT or expense reimbursement.
  • For items marked "fee does not depend on value" the amount entered is not used - enter 0.
  • The Tariff expresses amount-in-dispute bands in points; the dinar thresholds hold for a point value of 50 RSD, last checked 2026-09-20.

FAQ

How much does filing a lawsuit cost under the attorney tariff?

It depends on the amount in dispute (Tariff item 13). For a dispute up to RSD 50,000, drafting the claim is 200 points, i.e. RSD 10,000; up to RSD 850,000 it is 300 points (RSD 15,000); up to RSD 1,675,000 it is 375 points (RSD 18,750); up to RSD 3,350,000 it is 550 points (RSD 27,500). In disputes that cannot be valued the fee is fixed (Tariff item 14): a divorce claim or an unfair-dismissal claim is 550 points (RSD 27,500), a maintenance claim 300 points (RSD 15,000). Court fees and, where the attorney is VAT-registered, VAT come on top.

How much does a court hearing cost?

Under Tariff item 15, each hearing held earns the same fee as the statement of claim, plus 100 points (RSD 5,000) for every started hour. For a dispute up to RSD 850,000 that is 15,000 + 5,000 = RSD 20,000 for a hearing of up to one hour. For a hearing that was adjourned after the attorney appeared, the fee is 50% plus the started hour - RSD 12,500 in the same example.

What is the point value in 2025 and 2026?

One point is worth RSD 50.00 - Article 15 of the Tariff, as amended in the Official Gazette of the RS No. 56/2025 of 27 June 2025, applicable from 5 July 2025. Before that, from 3 June 2023, the point value was RSD 45.00 (Official Gazette No. 43/2023). As of the last check of this page (20 September 2026) no further amendment had been published.

Can an attorney charge less or more than the tariff?

Yes, but only under a written agreement with the client (Article 4 of the Tariff). There is a floor: the agreed fee may not be lower than 50% of the tariff amount. The current Tariff sets no upper limit. An hourly rate may also be agreed, at no less than 150 points (RSD 7,500) per started hour (Article 6), a flat fee for ongoing legal assistance other than representation before courts and authorities (Article 5), and a success fee in property-law matters of up to 30% (Article 7). A court awarding costs is not bound by the agreement between attorney and client.

Who pays the costs of proceedings and the attorney?

Each party first bears its own costs (Article 151 of the Civil Procedure Act). A party that loses the case entirely must reimburse the other party's costs; on partial success the court splits costs proportionally or orders each party to bear its own (Article 153). The court recognises only costs that were necessary and assesses them under the Tariff (Article 154), applying the tariff in force when the costs decision is made (Article 11 of the Tariff). Anything you agreed with your own attorney above the Tariff does not pass to the other side.

Does the tool cover every tariff item?

No. The Tariff has 81 items; the tool carries the most-used ones: valued civil disputes (items 13, 15, 16), a selection of non-valued disputes (item 14), enforcement (items 18-20), criminal proceedings by threatened sentence (item 1), contracts (items 75 and 76), advice, meetings and demand letters (items 78, 79, 81). For misdemeanour, non-contentious, administrative, insolvency and Constitutional Court proceedings, consult the text of the Tariff.

What if the point value changes in the meantime?

The fee is calculated under the tariff in force at the time of calculation (Article 10 of the Tariff), and a court applies the tariff in force when it decides on costs (Article 11). Because the amount-in-dispute bands are themselves expressed in points, a change in the point value moves the dinar thresholds of the bands as well as the fee amounts. The tool prints the point value it used with every result - if it differs from the one in force, do not use the result.

Are points calculated differently for out-of-court work?

The method is the same - points times the point value - but the basis differs. For a contract with an assessable value the attorney chooses between Tariff item 13 and a percentage of the market value of the property of up to 2.5%, and the fee may not be below 550 points (item 75). For contracts without an assessable value the fee is fixed, e.g. 650 points for other contracts and 450 for a power of attorney (item 76). Legal advice is valued like the submission that would start the relevant proceedings (item 78), and a pre-action demand letter at 50% of that fee (item 81).
